Terms & Conditions
Majestic Epoxy Floors Inc.

1. INTRODUCTION
These Terms and Conditions ("Agreement") govern all services provided by Majestic Epoxy Floors Inc. ("Company", "we", "us", or "our") to any client ("Client", "you", or "your") within the Province of Ontario, Canada.
By accepting a quote, signing a contract, paying a deposit, or otherwise engaging our services, you agree to be legally bound by this Agreement.
2. SCOPE OF SERVICES
The Company provides epoxy flooring and related surface preparation, coating, and finishing services as outlined in the written estimate, quote, or invoice ("Project Scope").
Any work requested outside of the agreed Project Scope may result in additional charges and timeline adjustments.
3. ESTIMATES & PRICING
All estimates are valid for 30 days unless otherwise stated.
Pricing is based on visible conditions at the time of inspection. Hidden issues including, but not limited to, moisture problems, structural deficiencies, or existing coating failures may result in additional costs.
The Company reserves the right to revise pricing if unforeseen conditions arise during preparation or installation.
4. DEPOSIT & PAYMENT TERMS
A non-refundable deposit of 30% is required to secure scheduling.
The remaining balance is due in full upon substantial completion of the project, unless otherwise agreed in writing.
Accepted payment methods include credit card, debit, e-transfer, and cheque.
Late payments may be subject to a $150 administrative fee plus interest at a rate of 2% per month (24% annually) on outstanding balances.
The Company reserves the right to suspend or delay services for non-payment.
5. SCHEDULING & DELAYS
Project dates are estimates and may be subject to change due to weather, site conditions, material availability, or other unforeseen circumstances.
The Company is not liable for delays beyond its reasonable control.
The Client agrees to provide clear and unobstructed access to the work area on scheduled dates.
6. SITE CONDITIONS & CLIENT RESPONSIBILITIES
The Client is responsible for:

Removing all furniture, vehicles, and personal items from the work area prior to the start date

Ensuring adequate access to electricity and workspace

Informing the Company of any known issues with moisture, cracks, or prior coatings
Failure to meet these conditions may result in delays or additional charges.
7. SURFACE PREPARATION & LIMITATIONS
Proper adhesion depends on existing concrete conditions. While the Company uses industry-standard preparation methods, we do not guarantee against:

Future cracking due to structural movement

Moisture vapor transmission
-
Pre-existing substrate defects
Minor imperfections, variations in texture, color, or finish are inherent to epoxy systems and are not considered defects.
8. CHANGE ORDERS
Any modifications to the original scope must be documented and approved in writing.
Additional work will be billed separately and may impact project timelines.
9. CANCELLATION POLICY
Deposits are strictly non-refundable under all circumstances.
If the Client cancels within 72 hours of the scheduled start date, the Company reserves the right to charge up to 50% of the total project value.
The Company reserves the right to cancel or reschedule due to unsafe conditions, non-payment, or unforeseen circumstances.
10. WARRANTY
The Company provides a limited warranty on workmanship for a period of 2 years from the date of completion.
This warranty does not cover:

Damage caused by misuse, neglect, or improper maintenance

Exposure to harsh chemicals or extreme conditions

Normal wear and tear
-
Structural or substrate-related issues
All warranty claims must be submitted in writing.
11. LIABILITY LIMITATION
To the fullest extent permitted by Ontario law, the Company shall not be liable for indirect, incidental, or consequential damages.
The Company’s total liability shall not exceed the total amount paid by the Client for the services provided.
12. INSURANCE & SAFETY
The Company maintains appropriate liability insurance.
The Client agrees to keep pets, children, and unauthorized individuals away from the work area during the project.
13. INTELLECTUAL PROPERTY & MARKETING
The Company reserves the right to take photographs and videos of the project before, during, and after completion for marketing and promotional purposes.
No personal identifying information will be disclosed without consent.
14. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
15. ENTIRE AGREEMENT
This document, along with any written estimate, quote, or invoice, constitutes the entire agreement between the parties.
Any prior discussions or agreements are superseded unless included in writing.
16. ACCEPTANCE
By proceeding with the services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
