1. INTRODUCTION
These Terms and Conditions ("Agreement") govern all services provided by Majestic Epoxy Floors Inc. ("Majestic Epoxy Floors", "Company", "we", "us", or "our") to any client ("Client", "you", or "your").
These Terms and Conditions apply to epoxy flooring, concrete preparation, coating, resurfacing, repair, finishing, and related services provided by the Company.
By accepting an estimate, quotation, contract, invoice, submitting a deposit or other payment, scheduling work, or otherwise engaging Majestic Epoxy Floors for services, the Client acknowledges that they have reviewed and agreed to these Terms and Conditions.
These Terms and Conditions are intended to be read together with the applicable written estimate, quotation, invoice, change order, warranty terms, and other written project documents provided by Majestic Epoxy Floors.
If a project-specific written agreement expressly modifies a term contained herein, the project-specific written agreement will govern that specific matter.
Nothing in these Terms and Conditions is intended to limit or exclude any right or remedy that cannot legally be limited or excluded under applicable law.
2. SCOPE OF SERVICES
Majestic Epoxy Floors provides concrete surface preparation, epoxy flooring, polyaspartic and related coating systems, full-broadcast flake flooring, metallic flooring, solid-colour systems, quartz systems, moisture-vapour-barrier systems, crack repair, and related services as specifically described in the Client's written estimate or quotation.
The exact materials, coating system, preparation requirements, colours, decorative products, topcoats, finish, number of coats, repairs, and other services included in a project are determined by the written Project Scope.
Any work, materials, preparation, repairs, coatings, design changes, or additional services not specifically included in the Project Scope may result in additional charges and changes to the project schedule.
3. ESTIMATES & PRICING
Estimates are generally valid for 30 days unless otherwise stated in writing.
Pricing is based on the information and visible site conditions reasonably available to Majestic Epoxy Floors when the estimate is prepared.
Existing concrete may contain conditions that are not reasonably visible or discoverable before mechanical preparation begins.
These conditions may include, but are not limited to:
• Excessive moisture or moisture-vapour transmission
• Contamination, oil, grease, chemicals, or other substances
• Existing coatings or adhesives
• Weak, deteriorated, porous, or unsound concrete
• Previous repair materials
• Hidden cracks or structural deficiencies
• Delamination or hollow areas
• Excessive surface damage
• Improper previous installations
• Conditions requiring additional grinding, removal, repair, or preparation
Where unforeseen conditions are discovered, Majestic Epoxy Floors may recommend additional preparation, repairs, materials, or other work before proceeding.
Additional work may result in additional charges and/or adjustments to the project schedule.
4. DEPOSIT & PAYMENT TERMS
A 30% deposit is generally required to secure scheduling, reserve labour, allocate materials, and reserve production time for the project, unless a different deposit amount is expressly stated in writing.
The deposit is non-refundable except where a refund is required by applicable law or otherwise agreed to in writing by Majestic Epoxy Floors.
Work will not normally commence until the required deposit has been received and cleared.
The remaining project balance is due in full upon substantial completion of the project, unless a different payment arrangement has been agreed to in writing before commencement.
Substantial completion means that the principal contracted flooring work has been completed and the installed system is substantially complete and ready for the applicable curing period, notwithstanding minor cosmetic items, curing time, ordinary cleanup, or other minor items that do not materially prevent the Client from receiving the principal benefit of the contracted work.
Minor aesthetic variations, ordinary curing characteristics, reasonable industry tolerances, or items that do not materially affect the functionality of the flooring system do not constitute grounds for withholding the undisputed project balance.
Accepted payment methods may include e-transfer, credit card, debit, cheque, or other payment methods approved by Majestic Epoxy Floors.
Credit card processing fees may apply where disclosed to the Client before payment.
5. LATE PAYMENT & DEFAULT
The project balance becomes due upon substantial completion unless otherwise agreed in writing.
A $150 administrative fee may apply to balances that remain unpaid after the completion date.
Where permitted by applicable law and the applicable agreement, overdue balances may also be subject to interest or other reasonable collection costs.
If payment remains outstanding, Majestic Epoxy Floors may suspend further services, decline additional work, and pursue lawful collection remedies.
The Client may be responsible for reasonable collection costs, administrative costs, and legal costs to the extent permitted by applicable law and the applicable agreement.
WARRANTY & OUTSTANDING BALANCES
The contractual warranty described in these Terms and Conditions is conditional upon the Client satisfying all applicable payment obligations.
If the Client fails to pay the full undisputed project balance within 7 calendar days after substantial completion, Majestic Epoxy Floors may suspend or deny contractual warranty service until the account has been brought current, to the maximum extent permitted by applicable law.
Nothing in this provision is intended to waive, limit, or exclude any statutory right or remedy that cannot legally be excluded.
6. COMPLETION & ACCEPTANCE OF WORK
Upon substantial completion, the Client is responsible for promptly inspecting the completed work and notifying Majestic Epoxy Floors of any material concerns.
The Client's use of the flooring system, moving items onto the finished surface, placing vehicles or equipment on the surface after the applicable curing period, or otherwise treating the project as complete may constitute evidence of acceptance of the completed work, subject to applicable statutory rights and the express warranty provisions contained herein.
Minor aesthetic characteristics and normal installation variations do not constitute deficiencies.
7. PROJECT SCHEDULING & DELAYS
Project dates and completion timelines are estimates and are not guaranteed unless expressly agreed otherwise in writing.
Project timing may be affected by:
• Weather
• Temperature
• Humidity
• Concrete temperature
• Moisture levels
• Substrate conditions
• Existing coatings
• Repairs
• Material availability
• Product curing requirements
• Additional preparation
• Client delays
• Access limitations
• Other conditions outside the Company's reasonable control
Majestic Epoxy Floors may postpone or reschedule work where environmental or substrate conditions are unsuitable for proper installation.
The Company will prioritize proper preparation, application, curing, and installation standards over maintaining a specific completion date where the two cannot reasonably be achieved simultaneously.
Majestic Epoxy Floors is not responsible for delays caused by conditions outside its reasonable control.
8. SITE READINESS & CLIENT RESPONSIBILITIES
The Client is responsible for ensuring that the work area is fully cleared and accessible before the scheduled installation date.
Unless otherwise agreed in writing, the Client must remove:
• Vehicles
• Furniture
• Storage items
• Personal belongings
• Tools and equipment
• Decorations
• Other items located within the work area
The Client must provide reasonable access to the property and work area, including access to electricity and other site requirements reasonably necessary to perform the work.
The Client must disclose known issues involving:
• Moisture
• Water intrusion
• Cracking
• Settlement
• Previous coatings
• Previous repairs
• Structural issues
• Drainage problems
• Other known substrate concerns
Failure to properly prepare the site may result in additional labour, delays, rescheduling charges, or other costs.
Majestic Epoxy Floors is not responsible for damage to items that the Client fails to remove from the work area or that are left within areas designated for construction.
9. CONCRETE & SUBSTRATE CONDITIONS
Epoxy and resinous flooring systems are installed over existing concrete. The coating system does not replace, structurally repair, or guarantee the condition of the underlying concrete.
Concrete is a natural and continuously changing substrate.
Existing or future conditions may include:
• Cracking
• Shrinkage cracking
• Structural movement
• Settlement
• Heaving
• Shifting
• Expansion and contraction
• Moisture movement
• Spalling
• Deterioration
• Delamination
• Surface contamination
Majestic Epoxy Floors will repair visible and reasonably accessible cracks and deficiencies included within the agreed Project Scope.
Crack repair is intended to address existing visible cracking but does not guarantee that cracks will never reappear.
If the underlying concrete moves, cracks, settles, shifts, deteriorates, or otherwise fails after installation, resulting coating damage is not considered a failure of the coating system unless specifically determined to be covered under the applicable warranty.
10. MOISTURE & MOISTURE-VAPOUR TRANSMISSION
Moisture is one of the primary factors that can affect resinous flooring systems.
Majestic Epoxy Floors may recommend or include a Moisture Vapour Barrier ("MVB") system where appropriate or where specified in the Project Scope.
Unless expressly included in writing, an MVB is not automatically included in every project.
Even where an MVB system is installed, Majestic Epoxy Floors does not guarantee that future moisture conditions, hydrostatic pressure, water intrusion, drainage issues, or structural moisture problems will never occur.
The Client is responsible for disclosing known water intrusion, flooding, drainage, foundation, plumbing, or moisture issues.
11. MECHANICAL SURFACE PREPARATION
Proper mechanical preparation is an essential component of a durable flooring installation.
Majestic Epoxy Floors generally uses mechanical diamond grinding and/or other appropriate preparation methods to prepare the concrete surface for the specified coating system.
The purpose of preparation is to remove surface contaminants and create an appropriate concrete surface profile for coating adhesion.
Preparation cannot eliminate defects or conditions that originate within the concrete itself.
Areas inaccessible to mechanical preparation, areas concealed by fixed structures, or areas outside the agreed work zone may not receive the same preparation as fully accessible areas.
Warranty coverage may be affected where a coating system is installed over a surface that was not mechanically prepared by Majestic Epoxy Floors.
12. DECORATIVE & COLOUR VARIATIONS
All resinous flooring systems are hand-applied and site-finished.
Natural variation is an inherent characteristic of these systems.
Reference photographs, sample boards, colour chips, and previous installations are examples of general appearance only and do not guarantee an identical final result.
METALLIC EPOXY FLOORING
Metallic epoxy systems are decorative, artistic flooring systems.
The final appearance is affected by application technique, product characteristics, environmental conditions, temperature, substrate conditions, lighting, pigments, solvents, rollers, squeegees, tools, and curing conditions.
Metallic systems may naturally contain:
• Colour movement
• Clouds
• Veining
• Swirls
• Comets
• Cells
• Depth variations
• Pigment concentration changes
• Colour transitions
• Artistic movement
• Minor surface texture variations
• Other visual characteristics created during installation
No two metallic floors will be identical.
The Client acknowledges that a metallic floor is a custom artistic finish rather than a digitally reproduced image.
The presence of comets, clouds, colour movement, pigment variation, artistic patterns, or other natural characteristics of a metallic system does not constitute a defect.
13. FLAKE FLOORING VARIATIONS
Flake flooring systems may naturally exhibit variation in flake distribution, density, colour, texture, and appearance.
Small differences in flake orientation, overlap, distribution, and texture are normal characteristics of a hand-installed system.
The final appearance may also vary depending on lighting, flake size, broadcast density, topcoat selection, application technique, and site conditions.
These characteristics do not constitute defects.
14. FLAKE FLOORING TEXTURE & SLIP RESISTANCE
Full-broadcast flake flooring systems are intentionally textured.
The combination of decorative flakes and protective topcoat creates a surface that may feel noticeably rougher or more textured than smooth interior flooring.
This texture is an intentional characteristic of the system and may contribute to improved traction and slip resistance.
The Client acknowledges that a flake flooring system is not intended to have the same smooth feel as polished concrete, tile, vinyl, or other smooth flooring surfaces.
Texture may vary depending on flake size, flake distribution, broadcast density, topcoat selection, and application technique.
Minor texture variation is normal and does not constitute a defect.
Slip resistance is not an absolute guarantee against slipping. Wet, contaminated, icy, oily, or otherwise hazardous conditions can make any flooring surface slippery.
15. TOPCOAT CHARACTERISTICS & ORANGE-PEEL TEXTURE
The final texture and appearance of a flooring system may be affected by the selected topcoat and application method.
Depending on the product selected, environmental conditions, application method, and curing conditions, the finished surface may exhibit minor characteristics such as:
• Orange-peel texture
• Roller texture
• Fine surface texture
• Minor stippling
• Minor variations in gloss
• Minor micro-bubbles
• Minor pinholes
• Minor surface irregularities
These characteristics can occur naturally during the application and curing of resinous coatings.
A completely glass-like or optically perfect surface is not guaranteed unless expressly specified in writing.
The presence of minor texture or other normal application characteristics does not, by itself, constitute a defective installation.
16. INSTALLATION STANDARDS & TOLERANCES
Epoxy and resinous flooring systems are site-applied products rather than factory-manufactured sheets.
Minor variations may occur as part of normal installation and curing.
Reasonable variations in colour, texture, gloss, flake distribution, metallic movement, roller marks, micro-bubbles, pinholes, minor surface characteristics, and other aesthetic characteristics are considered inherent to the installation process.
A reasonable tolerance of up to approximately 5% variation in overall visual appearance may be considered acceptable depending on the flooring system and viewing conditions.
This tolerance does not override any specific defect or workmanship obligation that may apply under applicable law.
17. CURING, FOOT TRAFFIC & MOVING ITEMS
Different coating systems require different curing periods.
The Client must follow all curing and post-installation instructions provided by Majestic Epoxy Floors.
Unless otherwise instructed, the Client must not move furniture, equipment, vehicles, heavy objects, or other items onto the flooring before the Company confirms that the applicable curing period has been reached.
Metallic epoxy systems may require approximately 6–7 days to reach full cure before heavy items are moved onto the surface, depending on product selection and environmental conditions.
The floor may be ready for limited foot traffic before it has reached full cure.
Early use, dragging furniture, placing heavy loads, parking vehicles, exposing the coating to chemicals, or otherwise using the surface before the recommended curing period may damage the system and may affect warranty coverage.
The applicable curing period communicated for the specific project takes precedence over general curing information published on the website.
18. MAINTENANCE & CLEANING
The Client is responsible for maintaining the installed flooring system in accordance with the care and maintenance instructions provided by Majestic Epoxy Floors.
Failure to properly maintain the flooring may affect appearance, performance, longevity, and warranty coverage.
The Client should avoid:
• Harsh or incompatible cleaning chemicals
• Abrasive cleaning methods
• Standing water where inappropriate
• Chemical exposure
• Dragging heavy objects across the floor
• Excessive impact
• Improper equipment or cleaning products
Normal wear resulting from ordinary use is not a warranty defect.
19. CHANGE ORDERS & ADDITIONAL WORK
Any modification to the original Project Scope may constitute a change order.
Change orders may include additional:
• Grinding
• Crack repair
• Coating removal
• Moisture mitigation
• Surface preparation
• Materials
• Labour
• Decorative work
• Repairs
• Flooring areas
• Design changes
Additional work may result in additional charges and/or changes to the project schedule.
Where reasonably practicable, additional work will be communicated to the Client before the work is performed.
20. CANCELLATION & RESCHEDULING
Deposits are intended to reserve labour, scheduling, production capacity, and materials and are therefore non-refundable except where required by applicable law.
If a Client requests cancellation or rescheduling after labour, materials, production time, or project scheduling have been committed, Majestic Epoxy Floors may be entitled to recover reasonable costs incurred, subject to applicable law and the terms of the applicable agreement.
Where a project is cancelled or rescheduled shortly before the scheduled start date, the Company may apply reasonable charges associated with the cancellation or rescheduling to the extent permitted by law.
Nothing in this section limits any cancellation or cooling-off rights provided to consumers by applicable Ontario legislation.
21. WARRANTY
LIFETIME LIMITED WARRANTY
Majestic Epoxy Floors provides a Lifetime Limited Warranty against peeling or delamination under normal residential use for qualifying residential full-broadcast flake flooring systems where a Moisture Vapour Barrier ("MVB") system has been expressly included in the original Project Scope and installed by Majestic Epoxy Floors.
The Lifetime Limited Warranty applies only to the original installation owner and is non-transferable.
The Lifetime Limited Warranty is limited to the service life of the installed flooring products and applies only to peeling or delamination attributable to covered installation or product-related failure under normal residential use.
The Lifetime Limited Warranty does not mean that the coating, concrete, substrate, or property is physically indestructible.
It does not guarantee that the underlying concrete will never crack, move, settle, deteriorate, transmit moisture, or experience other changes.
22. SIX-YEAR LIMITED WARRANTY
Residential flake systems installed without an MVB, metallic epoxy systems, solid-colour systems, quartz systems, commercial flooring systems, and other flooring systems that do not expressly qualify for the Lifetime Limited Warranty are covered by a 6-Year Limited Warranty against peeling or delamination under normal use, subject to all exclusions, limitations, payment requirements, maintenance requirements, and other conditions contained herein.
The warranty period begins on the date of substantial completion unless otherwise stated in writing.
23. WHAT THE WARRANTY COVERS
Subject to all applicable terms and exclusions, the warranty is intended to address qualifying premature peeling or delamination of the installed coating system caused by covered installation or product-related failure.
The Company's determination of whether a reported issue constitutes peeling, delamination, or another covered condition may require an inspection of the affected area.
Warranty coverage does not automatically apply to every crack, chip, scratch, stain, colour change, texture variation, cosmetic imperfection, or other change that occurs after installation.
24. WARRANTY EXCLUSIONS
The warranty does not cover:
• Physical, impact, abrasion, or mechanical damage
• Scratches, gouges, chips, or damage caused by objects, equipment, vehicles, tools, or furniture
• Misuse, neglect, abuse, or improper maintenance
• Failure to follow curing instructions
• Premature use of the floor before the required curing period
• Vehicle fluid leaks or chemical spills
• Exposure to harsh chemicals or incompatible cleaning products
• Excessive heat, fire, flooding, or extraordinary environmental conditions
• Cracking, movement, shifting, settlement, heaving, or failure of the underlying concrete
• Structural movement or substrate failure
• Moisture intrusion or excessive moisture conditions outside the Company's control
• Damage caused by water intrusion, drainage problems, plumbing failures, flooding, or hydrostatic pressure
• Normal wear and tear
• Cosmetic changes resulting from ordinary use
• Colour variation or changes caused by UV exposure, lighting, or environmental conditions
• Natural metallic movement or artistic variation
• Comets, clouds, swirls, cells, veining, pigment movement, or other natural metallic characteristics
• Normal flake distribution or texture variation
• Normal orange-peel, roller, stippling, or other minor topcoat texture
• Normal micro-bubbles, pinholes, or minor curing characteristics
• Changes caused by improper cleaning or maintenance
• Repairs, modifications, coatings, touch-ups, or alterations performed by third parties
• Areas that were not mechanically prepared by Majestic Epoxy Floors
• Damage caused by unauthorized repairs or modifications
• Damage caused by moving heavy objects before the recommended cure time
• Damage caused by vehicles or heavy equipment being placed on the surface before the recommended cure time
• Damage caused by unauthorized use or misuse of the flooring system
• Conditions resulting from work performed by another contractor or third party
• Conditions outside the reasonable control of Majestic Epoxy Floors that compromise the coating or substrate
25. WARRANTY CONDITIONS
Warranty claims must be reported to Majestic Epoxy Floors within a reasonable period after the Client discovers or should reasonably have discovered the alleged issue.
The Client must provide reasonable access to the affected area so that Majestic Epoxy Floors may inspect and assess the condition.
The Company reserves the right to inspect the flooring before determining whether a warranty claim is covered.
The Client must not attempt to repair, coat, modify, grind, remove, or otherwise alter the affected area before the Company has had a reasonable opportunity to inspect it.
Unauthorized repairs or modifications may void applicable contractual warranty coverage to the extent permitted by law.
Where a valid warranty claim is approved, Majestic Epoxy Floors may, at its reasonable discretion, repair or otherwise remedy the covered condition.
The warranty does not guarantee that the repaired area will be visually identical to the original installation where materials, batches, colours, environmental conditions, or substrate conditions have changed.
26. WARRANTY & PAYMENT STATUS
Warranty coverage is conditional upon the Client complying with the payment terms of the project.
An unpaid or disputed account does not automatically establish a warranty claim.
Where an undisputed project balance remains unpaid beyond the applicable payment period, contractual warranty service may be suspended until the account is brought current, to the extent permitted by applicable law.
Nothing in this provision is intended to eliminate any statutory rights or remedies that cannot legally be excluded.
27. WARRANTY TRANSFERABILITY
All warranties are issued solely to the original Client and original installation owner.
The warranty is non-transferable and does not automatically transfer upon sale, rental, assignment, or other transfer of the property.
28. NO GUARANTEE AGAINST FUTURE CONCRETE FAILURE
The Client acknowledges that epoxy and resinous flooring systems are installed over concrete and therefore remain subject to the behaviour of the underlying substrate.
No warranty provided by Majestic Epoxy Floors guarantees that the underlying concrete will remain crack-free, level, structurally sound, dry, or unchanged for the duration of the warranty period.
Future concrete movement, settlement, cracking, moisture intrusion, or substrate failure may damage the coating without constituting a failure of the Company's workmanship.
29. PHOTOGRAPHS & MARKETING
Majestic Epoxy Floors may photograph or record the work area before, during, and after installation for documentation, quality-control, portfolio, advertising, and marketing purposes.
The Company will not intentionally publish personal identifying information without appropriate consent.
30. SAFETY & ACCESS
The Client must keep children, pets, visitors, and unauthorized persons away from the work area during installation and curing.
The Client acknowledges that construction and coating work may involve dust, odours, tools, machinery, wet coatings, curing materials, and other temporary hazards.
The Company may stop work or restrict access where conditions are unsafe.
31. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Majestic Epoxy Floors will not be responsible for indirect, incidental, special, punitive, or consequential damages arising from the installation or use of the flooring system.
To the fullest extent permitted by law, the Company's aggregate liability arising from a project will not exceed the amount actually paid to Majestic Epoxy Floors for the specific services giving rise to the claim.
Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited under applicable law.
32. CUSTOMER PROPERTY
The Client is responsible for removing or protecting personal property located within or near the work area.
Majestic Epoxy Floors is not responsible for damage to property that the Client leaves within the work area or fails to identify as requiring protection.
33. THIRD-PARTY PRODUCTS & CONDITIONS
Certain projects may involve products manufactured by third-party suppliers.
Product performance may depend on manufacturer specifications, environmental conditions, substrate conditions, installation methods, and maintenance.
Where a manufacturer provides a separate product warranty, that warranty may apply independently of the Company's workmanship warranty.
34. GOVERNING LAW
These Terms and Conditions are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
Any provision of these Terms and Conditions that is found to be invalid, unenforceable, or contrary to applicable law will be interpreted or modified to the minimum extent necessary to comply with the law, and the remaining provisions will continue in effect.
35. These Terms and Conditions, together with the applicable estimate, quotation, invoice, written contract, change orders, warranty documents, and other written project-specific agreements issued by Majestic Epoxy Floors, constitute the agreement between the Company and the Client concerning the project.
Verbal representations or discussions that are not included in the written project documents will not modify the agreed Project Scope unless confirmed in writing by Majestic Epoxy Floors.
36. ACCEPTANCE OF TERMS
By accepting an estimate, signing an agreement, submitting a deposit or other payment, scheduling work, or proceeding with services, the Client acknowledges that they have had an opportunity to review these Terms and Conditions and agrees to be bound by them, subject always to any rights and protections that cannot legally be waived under applicable law.
